We - meaning you and B1G1 Giving - have a commitment to work together to make a difference through this website (Giving Life).
2. INTEGRITY OF WORTHY CAUSES
As an individual user of Giving Life, you have the opportunity to make contributions to the Worthy Causes that are listed on the B1G1 Giving Engine. These are carefully selected Worthy Causes that meet specific criteria set by B1G1 Giving. However, further enquiries from the public can be made directly to the relevant organisations. B1G1 Giving disclaims all liability for the accuracy and completeness of any information provided by the Worthy Cause Members, their sponsors, or any other third party. B1G1 Giving discloses complete information provided by the organisations and encourages all users to take extra care and interest in selecting and in donating to the Worthy Causes listed. B1G1 Giving reserves the right, in its absolute discretion, to withdraw the listing of any Worthy Cause. In that event, funds previously contributed to that Worthy Cause will be remitted in accordance with Section 8 below, but no further funds will be solicited on behalf of the Worthy Cause.
3. LOGO AND BRAND USAGE
Only B1G1 Businesses – that is, those who have joined the fee-based membership program offered to business owners - have the right to use the business member logos and supplied marketing materials under licence from B1G1. Contributing to the Worthy Causes listed on Giving Life as an individual user does not allow you or your company to use any of the marketing messages and intellectual property of B1G1 Giving. Further, any unauthorised use of this intellectual property is expressly prohibited. The ownership of the B1G1 logos and marketing materials stays with B1G1 Giving under the licence of Buy1GIVE1 Pte Ltd (Singapore).
4. B1G1 GIVING'S RIGHT TO CANCEL USER ACCOUNT
B1G1 Giving reserves the right to cancel a user account should B1G1 believe in good faith that the member or user may have engaged, or may be about to engage, in any conduct that would violate any applicable law, or would constitute misrepresentation, or would be likely, in the view of B1G1, to damage the reputation of B1G1 Giving.
5. GOVERNING LAW
This Agreement shall be construed as operating under the laws of the Republic of Singapore. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in Singapore in accordance with the then-current Arbitration Rules of the Singapore International Arbitration Centre ("SIAC Rules"), which are deemed to be incorporated by reference in this Agreement. The Tribunal shall consist of a single arbitrator, and all proceedings shall be conducted in English.
Members and users of B1G1 Giving Engine have no liability whatsoever for any of B1G1 Giving's (registered society in Singapore) operations or services, nor for any of its assets, liabilities or obligations. Although B1G1 Giving conducts reasonable inquiry into the activities of each Worthy Cause Member, B1G1 Giving disclaims all liability for the accuracy and completeness of any information provided by the Worthy Cause Members, their sponsors, or any other third party.
7. MEMBERSHIP/ADMINISTRATION FEES
Our B1G1 Business community supports the activities of B1G1 Giving, directly enabling the transparent administration and remittance of your contributions. Users of the B1G1 Giving Engine such as the users of Giving Life who do not hold this membership status are encouraged to contribute to cover the administration cost for each giving transaction. This fee is displayed during the checkout process and can be increased or removed through your choice of projects.
8. 100% TO WORTHY CAUSE
B1G1 guarantees that, except for the Administration Fee described above, 100 per cent of your contribution goes directly to the Worthy Cause Member you select. When an accumulated amount of contributions reaches $500 SGD, the funds are transferred to the Worthy Cause Member in the following month, together with a remittance advice listing the dedicated projects and deducted bank charges. Unless special arrangements are made, amounts smaller than $500 SGD will be held in B1G1 Giving's account in Singapore in order to avoid the high bank charges for small transactions. If funds held by B1G1 Giving in a Worthy Cause Member's account for 12 months are less than $500 SGD, then B1G1 will take one of the following actions: (a) if the account balance is less than $500 SGD, but greater than the cost of the associated bank charges for collection and transfer, then B1G1 will remit the amount to the Worthy Cause Member; or (b) if the account balance is less than the cost of the associated bank charges for collection and transfer, then B1G1 will close the Worthy Cause Member's account, and remit the remaining funds to a worthy cause organisation selected by the B1G1 Giving Board.
9. TRANSFER & CANCELLATION OF CONTRIBUTIONS.
Contributions authorized by an individual user may not subsequently be transferred to another organisation without the prior written approval of B1G1 Giving, which it may withhold in its absolute discretion.
10. CHANGES IN TERMS & CONDITIONS
B1G1 Giving reserves the right to modify or supplement these Terms and Conditions at any time and without prior notice; however, in the event of a material change, we will post an alert on our homepage for 30 days to alert users to the change.
a. When you create an account on B1G1 Giving, we collect basic information about you through the registration process - your name, email address, and a means to authenticate your account (for example, a password).
b. B1G1 Giving will also collect information on your giving transactions (for example, amounts you give, recipients of your donations, dates of the transactions, and specific projects supported) and make that information available to you on your private B1G1 Giving account page.
c. By establishing an account on B1G1 Giving, you agree to receive emails or other written communication, such as physical mail, based on your account status or activity (for example, confirmation receipts for donations you have made, confirmation of email address or password changes, or customer service inquiries regarding the status of or activity in your account).
d. By default, you may receive periodic newsletter emails from B1G1 Giving. The frequency of these newsletters may vary. You can choose not to receive these newsletters through a preference on the website, or by clicking the Unsubscribe link included at the end of each email.
e. B1G1 Giving will not disclose your personally identifiable giving activity to any third party without your consent. B1G1 Giving reserves the right to record and display giving activity on the website in aggregated (anonymous) form.
f. B1G1 Giving's service providers, agents and representatives may be provided access to your personally identifiable information as part of, or incident to, their provision of services to B1G1 Giving (for example, processing of giving transactions). All such access shall be under appropriate confidentiality agreements and limited to use to provide services to B1G1 Giving.
h. Similar to many websites, if a website user has enabled cookies in their browser, B1G1 Giving, independently and through enabled third party tools and programs, collects certain technical information utilizing a cookie file, such as the path of users to the website, pages visited, originating IP address, browser type, browser language, and the date and time of the user's visit. This information helps B1G1 Giving track trends and improve areas of our website based on visits, and are common analytics used by most websites.
i. This website is intended to be used by adults. It is not intended for children, and B1G1 Giving does not want to collect any personal information for users who are under the age of 13. B1G1 Giving recommends that parents do not post, or permit others to post, any personally identifiable information with respect to persons under the age of 13.
